Terms & Conditions
Contract: Lockyer Sheds shall supply the goods and services as specified on the Invoice / order form, for the price as stated.
Commencement: Goods shall not be delivered nor will the contractors commence work until the customer’s payments are up to date. Any time quoted is an estimate only. All stages of shed construction are very subject to the weather conditions at all times. Lockyer Sheds will treat the estimated time as a target date and will make every reasonable effort to meet that date.
Site: The price is quoted as a level site(maximum 100mm difference), which includes Bobcat time – 1Hr travel & 1Hr site preparation. All costs incurred in additional work on site or plant equipment required to do so, is payable by the customer. All additional concrete and/or fill required, due to site leveling, (eg. piers are required to be embedded into natural ground) is also payable by the customer.
Site Clearance: For all buildings the customer must provide, for building purposes, a clear and level pad with at least an additional 1.5 metre wide area around the entire building. If there is not a 1.5 metre level and clear area around the site Lockyer Sheds is entitled to make additional charges for any additional expenses incurred. Clear access for entry of Bobcat, cement trucks etc. is assumed by Lockyer Sheds. All additional charges for access is payable by the customer. (Eg. Inadequate access may require a concrete pump)
Liability: Lockyer Sheds or its subcontractors shall not be liable for any loss or damage to customer’s property during delivery, site preparation and construction (eg. Underground services etc) Lockyer Sheds is not liable for any damages or shortages, in shed kits, unless notified within seven (7)days of receipt of material. Lockyer Sheds will take all care but no responsibility for any damages or shortages, if requested to store materials after seven (7) days of receipt of material.
Design: All designs are based on “A, S or M” soil rating (unless stipulated otherwise). If the soil rating for the proposed site is different from “A, S or M” then the customer is liable for all additional costs in placing concrete to a different design. Customers requiring buildings outside the design must advise Lockyer Sheds, in writing, of any changes from this design. Any additional expenses are payable by the customer. Unless noted otherwise Lockyer Sheds will provide guttering and downpipes to ground level. The customer shall be responsible for all other piping and stormwater requirements and for complying with all statutory authority requirements including all design modifications requested by statutory authorities.
Payment: The customer shall pay to Lockyer Sheds –
- The deposit at the time of signing the contract.
- The balance of the contract amount by progressive payments and/or final payment as specified in this contract. (All structures remain the property of Lockyer Sheds until fully paid and keys will only be handed to customer when payments are finalised)
The customer acknowledges that they may be obliged to pay Lockyer Sheds or any contractor amounts in respect to: a. Cancellation fee
b. Concrete work (additional work required for “H, P or E” soil)
c. Site work (additional hours required by the bobcat, over 2 hours)
All Shed/Carport kits are payable on delivery to Lockyer Sheds yard. Direct site deliveries (Stramit or external transport) are payable prior to delivery date advised by Lockyer Sheds.
Any Kit shed being held by Lockyer Sheds for more than 30 days after the delivery date given will incur a $50 per week holding fee.
Contractors: The customer acknowledges that Lockyer Sheds does not do building work and in particular placing concrete or laying slabs or erecting sheds. The customer authorises Lockyer Sheds as their agent to engage licensed contractors to place concrete and/or slabs and to erect structures. All additional work requested by the customer of the sub-contractors is the sole liability of the customer.
Power supply: The customer must provide adequate power supply where required. Additional cost incurred by Lockyer Sheds for a generator will be payable by the customer.
Risk: The goods are at the risk of the customer from the time of delivery to the customer’s site. The customer shall cover all materials on site against weather, damage and/or theft and will have no claim against Lockyer Sheds or its subcontractors in respect of any loss of or damage to the materials once they have been delivered to site. The customer has the sole responsibility for ensuring they have appropriate insurance to cover the said risk.
Title: All materials delivered to site by on behalf of Lockyer Sheds or its sub-contractors shall remain the property of Lockyer Sheds (or its sub-contractors) until payment in full of the total price together with any other costs or charges to be borne by the customer. Surplus and/or unused materials remain the property of Lockyer Sheds and sub-contractors are instructed to return same to Lockyer Sheds.
Alterations or variations: Any costs incurred by Lockyer Sheds for alterations or variations, which must be in writing, to the original agreed contract will be payable by the customer.
Cancellations: Lockyer Sheds will charge a fee of a 10% of the total price to cover processing costs, if cancelled prior to Lockyer Sheds ordering the shed kit, otherwise the customer is liable for all costs incurred to the date of cancellation.
Termination by Lockyer Sheds: Lockyer Sheds reserves the right to terminate or put a hold on the contract at any stage if the customer
- becomes unreasonable in the customer’s demands;
- is abusive of employees or contractors; or
- Fails to make any payment when due.
